Aliens — Expulsion of — Subsequent Grant of Entry Visa — Nullification of Expulsion Order — The Law of Chile.

The Facts.—Antonio Guardiola López, a Spanish national, was expelled from Chile in 1946 for having engaged in Communist activities and for interfering in Chilean politics. In 1953 he returned to Chile, travelling on an Uruguayan passport which had received a Chilean visa. He was arrested by the Investigation Service of the Government of Chile on the ground that the expulsion order was still outstanding. He sought his release in an amparo action.

Held: that amparo must be granted. The Court found that the grant of a Chilean visa to the petitioner...
