Resumen. Este artículo discute algunas condiciones del proceso
constituyente chileno introduciendo herramie ntas conceptuales y
teóricas que hasta ahora no han sido utilizadas en la discusión
constitucional chilena. En específico, sostenemos que una
comprensión cabal de este proceso requiere introducir la pregunta por
las condiciones materiales en que se inserta la Constitución. El artículo
comienza introduciendo la noción de poder constituyente, el que es
comprendido como la formu lación jurídica de la capacidad de agencia
colectiva que subyace a la democracia. A él se ab oca la sección I. Se
señala, luego, que para comprender dicha agencia colectiva es necesario
prestar atención a las condiciones materiales concretas, que en este caso
son las del capitalismo financiero global. La segunda secc ión de este
artículo examina en detalles dichas condiciones, siguiendo los trabajos
de Karl Polanyi, Wolfang Streeck y Thomas Piketty. La tercera sección
intenta mostrar de qué manera(s) precisa(s) las cond iciones materiales
impactan en la agencia colectiva de la comunidad política. Se concluye
expresando las que, a nuestro juicio, son las posibilidades y obstáculos
que enfrenta el proceso constituyente que Chile comienza a vivir
cuando este artículo sale a la luz.

Abstract. This a rticle discusses some conditions of the Chilean
constituent process by introducing conceptual and theoretical tools
that have not been used so far in the Chilean constitutional discussion.
Specifically, we argue that a thorough understanding of this process
requires introducing the question of the material conditions in which
the Constitution is inserted. The article begins by introducing the
notion of constituent power, which is understood as the legal
formulation of the capacity for the collective agency that underlies
democracy. Section I is devoted to it. It is then pointed out that to
understand such collective agency it is necessary to pay attention to the
concrete material conditions, which in this case are those of global
financial capitalism. The second section of this article examines these
conditions in detail, following the work of Karl Polanyi, Wolfgang
Streeck, and Thomas Piket ty. The third section attempts to show in
what precise way(s) material conditions impact on the collective agency
of the political community. It concludes by expressing what, in our
view, are the possibilities and obstacles facing the constituent process
that Chile is beginning to experience as this article comes to light.
